Acceptance of Terms
These Terms of Service ("Terms") govern all sessions, experiences, activities, and services provided by The Pew Estate LLC ("Company," "We," "Our"), a Florida limited liability company. By making a booking, attending a session, or being present on the property in any capacity, you ("Guest") agree to these Terms and all policies incorporated herein. If you do not agree to these Terms, you may not participate in any Company session or activity.
Eligibility
Participation in Company sessions is limited to individuals who meet all of the following requirements:
- Are at least twenty-one (21) years of age.
- Are legally eligible under federal and Florida law to handle the firearms that will be used in their session.
- Have not been convicted of any felony or any crime that would prohibit possession or use of firearms under applicable law.
- Are in good physical and mental health sufficient to safely participate in the activities described at booking.
- Have received and accepted an invitation or referral from a current guest or through the Company's authorized booking process.
A Guest under twenty-one (21) years of age may be present on the property only when accompanied at all times by a parent or legal guardian. The accompanying parent or guardian is the Guest of record and assumes full responsibility for the minor throughout the visit. Minors do not participate in any live firearm activity unless the Company has reviewed and approved the specific circumstances in advance and all applicable legal requirements are met.
Because this property involves live firearm activity, the Company reserves the right to decline any prospective Guest at any time and for any reason. No explanation is required.
Assumption of Risk
Guest acknowledges that participation in firearms activities, including precision shooting, NFA firearm operation, and nighttime field operations, involves inherent risks including physical injury, property damage, hearing impairment, or death, regardless of the safety protocols employed by the Company.
Guest voluntarily assumes all such risks, whether known or unknown, and agrees that the Company, its Members, officers, employees, contractors, and agents (collectively "Released Parties") shall not be liable for any injury, loss, or damage arising from Guest's participation.
Release of Liability and Indemnification
Guest hereby releases and discharges the Released Parties from any and all claims, demands, damages, losses, costs, and expenses of any kind arising from or relating to Guest's participation in any Company session or activity, whether caused by the negligence of the Released Parties or otherwise, to the fullest extent permitted by applicable law.
Guest further agrees to indemnify, defend, and hold harmless the Released Parties from any claims made by third parties arising from Guest's conduct on the property.
Safety and Conduct Requirements
Guest agrees to comply at all times with all safety instructions, commands, and directions given by the Company's guide team. The following rules are absolute and non-negotiable:
- No firearm shall be handled by any Guest at any time without the explicit direction of a Company guide.
- No alcohol shall be consumed during any range session, field operation, or firearms handling activity.
- No Guest shall handle any firearm while impaired by alcohol, medication, fatigue, or any other substance.
- Guests shall treat all firearms as loaded at all times.
- Guests shall never point any firearm at any person not involved in a sanctioned drill.
- Guests shall follow all cease-fire commands immediately and without question.
- Every person consuming alcohol on the property must be verified as twenty-one (21) years of age or older, without exception.
- Any Guest who arrives on the property visibly intoxicated will be denied access. No refund is issued.
Violation of any safety rule is grounds for immediate removal from the property without refund. Violations are addressed according to severity: minor violations are corrected verbally and logged; significant violations result in removal from the active session, with continued property access at the Company's discretion and no refund for the removed session; severe violations, including any conduct that creates immediate risk to any person on the property, result in immediate removal from the property with no refund, regardless of how much of the session has been completed.
Guest Verification and Property Liability
A Guest attending as the invitee of a Member must complete the Company's guest submission and verification process before arrival, including full legal name and at least one active social media handle. The Company conducts a character and conduct review before clearing any guest for attendance. A guest who is not cleared will not be admitted, and failure to submit required information on time may result in denial of access on the day of the session without refund of the guest fee.
Guests are financially responsible for any damage to Company property, equipment, or facilities, including firearms and night vision or thermal equipment, arising from negligent or unsafe conduct. This liability survives the conclusion of the session.
R&D Product Sessions and Non-Disclosure Agreements
Certain sessions provide access to pre-market or prototype products made available by manufacturer and brand partners. Where required by the manufacturer, Guest must execute a non-disclosure agreement before participating in that portion of the session. Guests are notified of any such requirement in advance of the applicable session. A Guest who declines to execute a required non-disclosure agreement is excluded from that specific session only and remains eligible for the remainder of the day's programming; no refund is issued for the excluded session.
Confidentiality
Guest acknowledges that The Pew Estate operates on a strictly confidential basis. Guest agrees not to disclose, publish, or share any of the following without the prior written consent of the Company:
- The identity of any other guest present on the property.
- The specific location of the property.
- The specific contents of the NFA inventory.
- Any proprietary operational detail of the Company, including on social media or any other public platform.
All media captured on the property is subject to prior approval by the Company.
Cancellation and Refund Policy
Access to The Pew Estate is not a transactional purchase of a venue or a date. It is participation in a private, curated circle extended to a limited number of members and their guests. The fee associated with a booking secures that access and the standard built around it, not the use of any particular property. The properties on which sessions and gatherings are held are made available to members at no additional charge; what is charged is the club itself, its curation, and the circle it protects.
For this reason, all bookings are non-refundable. Once a date is confirmed, the Company forgoes the opportunity to extend that place in the circle to another member or guest. No refund is issued for any cancellation, delay, or non-attendance, regardless of notice given or circumstance, unless expressly authorized in writing by the Managing Member.
- No refund: All fees are non-refundable except where the Managing Member, at their sole discretion, authorizes a credit or refund in writing.
- No-show: Full booking amount is forfeited.
- Conduct violation on property: Immediate removal and forfeiture of the full booking amount, regardless of how much of the session has been completed.
The Company reserves the right to cancel or reschedule any session for safety, weather, or operational reasons. Any credit or refund associated with a Company-initiated cancellation is extended solely at the discretion of the Managing Member and is not guaranteed by these Terms.
Medical Representation
Guest represents that they are in sufficient physical and mental health to safely participate in the booked session and that they have disclosed to the Company any medical condition, disability, or medication that may affect their ability to safely handle firearms.
The Company reserves the right to deny or restrict participation to any Guest whose participation presents a safety risk.
Governing Law
These Terms shall be governed by and construed under the laws of the State of Florida. Any dispute arising under these Terms shall be resolved exclusively in the courts of Miami-Dade County, Florida.
Guest Acknowledgment
By booking, attending, or participating in any session or activity operated by The Pew Estate LLC, Guest confirms that they have read and understood these Terms in their entirety, agree to be bound by them, and acknowledge that participation in all activities is entirely voluntary and undertaken at their own risk. These Terms constitute a binding legal agreement between Guest and The Pew Estate LLC.
